These Terms of Service (“Terms”) govern your use of the RespirAIA app and the website respiraiapp.com (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
1. Who we are
Online Presence Builder SRL (“RespirAIA”, “we”, “us”) is a Romanian limited liability company operating the RespirAIA service. Full company details on the Imprint page.

2. Eligibility
You must be 18 or older to use RespirAIA. We do not provide services to anyone under 18. You must provide accurate registration information and keep it up to date. You’re responsible for all activity under your account; don’t share credentials.
3. The Service — what RespirAIA is and isn’t
RespirAIA is a wellness and habit-support companion. It helps you track time without smoking or vaping, reflect on your journey, breathe through difficult moments, and build daily habits that support a smoke-free life.
RespirAIA is NOT:
- A medical device
- A treatment for nicotine addiction or any other condition
- A substitute for medical advice, diagnosis, or treatment
- A substitute for therapy, counseling, or mental-health care
- A substitute for emergency services
If you have a medical question, please talk to a qualified healthcare professional. If you’re in crisis, please contact the helpline numbers shown in the app or your local emergency services.
4. Subscriptions and billing
Plans
- Monthly: $9.99 / month
- Annual: $59.99 / year (~50% saving vs monthly)
A free tier is also available with reduced features. Subscriptions are sold exclusively via Apple App Store and Google Play. Local currency pricing is set per market (Apple and Google handle conversion + consumer-side VAT).
Free trial
Both Monthly and Annual plans include a 7-day free trial for new Premium subscribers. If you don’t cancel before the trial ends, the subscription auto-renews at the price quoted.
Auto-renewal
Monthly and Annual plans auto-renew at the end of each period unless you cancel. We email a renewal reminder 7 days before each annual renewal (and via the monthly receipt). You can cancel anytime via your platform’s subscription settings (Apple App Store or Google Play); we provide a deep link from in-app Settings → Subscription.
Refunds
App Store / Play Store refunds are handled by Apple and Google. Request via your platform settings. We will not dispute any platform-issued refund request made within 30 days of first purchase. For questions, email [email protected].
Pricing changes
If we change the price of a recurring subscription, we’ll notify you at least 30 days in advance. The new price applies on your next billing cycle.
5. Acceptable use
You agree NOT to:
- Use RespirAIA for anything illegal
- Reverse-engineer, decompile, or copy the app
- Resell access to your account
- Submit content that is defamatory, threatening, hateful, sexually explicit, or that violates someone else’s rights
- Make medical claims about RespirAIA in public reviews or testimonials
- Attempt to extract data on other users
- Use the AI coach to harass, threaten, or harm others
We may suspend or terminate accounts that violate these rules.
6. Your content
When you submit text (journal entries, AI coach messages, reviews, community posts when launched), you keep ownership. You grant us a limited license to process and display the content as needed to provide the Service.
We do not use your content to train AI models. We do not sell or share your content with advertisers.
7. AI coach disclaimer
The AI coach is powered by Anthropic’s Claude language models. The coach is not a doctor, therapist, or medical professional. The coach’s outputs are not medical advice and may occasionally contain inaccuracies.
If the AI coach detects mental-health crisis signals, it will pause coaching and route you to localized helplines. However, technology is not infallible — if you’re in crisis, please reach out directly to a real person via the helplines provided in the app.
8. Intellectual property
The Service, including its name, logo, design, written content, and AI prompts, is owned by Online Presence Builder SRL and protected by intellectual-property laws. You may not use our IP for your own purposes without permission.
9. Privacy
How we handle your personal data is described in our Privacy Policy. By using the Service, you also agree to that Policy.
10. Termination
You can delete your account at any time in Settings. Doing so soft-deletes immediately and hard-deletes after 30 days. Backups are purged within 90 days.
We can terminate accounts that violate these Terms after notice. We can also terminate the Service entirely with 90 days notice (you would receive a final data export and a pro-rated refund).
11. Disclaimers and limits of liability
To the maximum extent allowed by law, RespirAIA is provided “as is” without warranty of any kind. We don’t guarantee the Service will be uninterrupted, error-free, or that it will help you quit smoking. (The latter is genuinely true — quitting is a difficult journey, and outcomes depend on many factors beyond any single tool.)
Our total liability to you for any claim is limited to the amount you’ve paid us in the 12 months before the claim. This doesn’t apply to claims that can’t be limited under your local law.
12. Governing law and disputes
These Terms are governed by Romanian law, except where local consumer-protection laws of your country of residence apply. EU consumers may also use the EU’s online dispute resolution platform at ec.europa.eu/consumers/odr. UK consumers retain their rights under UK consumer-protection law.
13. Changes to these Terms
We update these Terms when our offering or law changes. Material changes are notified by email and in-app banner at least 30 days before they take effect.
